Update – July 8th, 2015
A proposed class action was commenced in the Federal Court of Canada by Richard Maynard against Air Canada, Delta Air Lines, Inc., American Airlines, Inc., United Airlines, Inc. and Southwest Airlines Co. alleging a conspiracy with each other or other airlines to:
A. fix, maintain, increase or control the price for the supply of tickets for air travel within the USA or between the USA and Canada;
B. allocate sales, territories, customers or markets for the supply of air travel within the USA or between the USA and Canada; and
C. fix, maintain, control, or lessen the supply of air travel services within the USA or between the USA and Canada.
Proposed Class
This action is brought on behalf of members of a proposed class consisting of Richard Maynard, the representative plaintiff, and all Canadian resident persons who purchased a ticket from any of the defendants for air travel within the United States, or between Canada and the United States during the period January 1, 2010 and the present (excluding the defendants, their employees and their respective parents, subsidiaries and affiliates). If you fit in this criteria, you may be eligible to participate in this proposed class action if it is certified (i.e., after the court confirms that the case may proceed as a class action). There is no date set yet for the certification hearing.

What Happens Next?
The first substantial step in a proposed class action is for the Court to consider whether the action can proceed as a class action, and define the class and the common issues to be determined on behalf of the class. This process is called “certification”. If the action is certified, all persons who fit the class definition will be automatically included in the class, but will have an opportunity to opt out (exclude themselves) from the proceeding. This process typically includes a notice effort.
