Stephen Libin

Stephen N. Libin is a partner at Branch MacMaster LLP in Toronto where he regularly handles “weird and wonderful” litigation. He applies his engineering and business education to a diverse legal practice with an emphasis on resolving complex class action, product liability, professional and general negligence, employment and environmental disputes. Stephen has trial, motion, application, and appeal experience and has appeared before the Courts of Appeal in Ontario, Nova Scotia and Saskatchewan.

Having gained significant experience defending class actions, Stephen served as lead counsel for defendants in two major class proceedings arising from the COVID-19 pandemic. He has also had the opportunity to represent clients in class actions involving insurance coverage, product recalls, medical devices, long-term care facilities and allegations of employee misclassification. He was recognized by his peers in the 2026 and 2027 editions of The Best Lawyers in Canada™ for his work in class action litigation.

Stephen has a particular interest in the law of evidence and the Rules of Civil Procedure. He was one of the authors of Canadian Defiance Lawyers’ submissions to the Civil Rules Committee (“CRC”) on proposed rules relating to AI and evidence and represented the organization in a series of related townhall meetings hosted by the CRC. He previously co-wrote CDL’s submissions to the CRC on changes to the rules on bifurcation and represented CDL as an intervenor at the Court of Appeal for Ontario in Moore v Getahun (communicating with experts) and Westerhof v Gee (categories of expert evidence).

Stephen sits on the editorial board of the Toronto Law Journal and regularly presents at continuing legal education seminars. He has volunteered with Pro Bono Ontario providing legal advice and trial representation to low-income Ontario residents and has served as a director on several not-for-profit organizations. Despite being a “reluctant hockey dad”, he can usually be found most evenings driving his three sons to cold rinks around the city.
